E-SIGN Consent and Electronic Communications Disclosure

This E-SIGN Consent and Electronic Communications Disclosure (“E-SIGN Consent”) applies to communications between you and Ten Figure Finance (“Ten Figure Finance,” “we,” “us,” or “our”) in connection with your application for, and any account you hold with us for, a working-capital product. By providing your consent (whether on the website, in our application, or in a transaction document), you agree to the terms below.

1. Scope of Your Consent

You consent to receive in electronic form any agreements, disclosures, notices, statements, change-in-terms notices, fee schedules, privacy notices (including this E-SIGN Consent, our Privacy Policy, and our GLBA Privacy Notice), tax forms, billing statements, payoff letters, default and adverse-action notices, state commercial financing disclosures, and any other communications or records that we, our affiliates, or our funding partners provide to you, are required by law to provide to you, or that you sign or submit to us, in connection with your application or account (collectively, “Communications”).

Your consent applies to Communications relating to the application you submit, any account that results from it, and any future applications or accounts you initiate with us, unless and until you withdraw your consent as described below.

If our hardware or software requirements change in a way that creates a material risk that you will not be able to access or retain a Communication, we will notify you of the revised requirements and give you the opportunity to withdraw your consent without charge.

You may request a paper copy of any Communication we have provided in electronic form by contacting us at sales@tenff.com or (833) 995-2068. We may charge a reasonable fee for paper copies as permitted by applicable law; we will tell you the fee, if any, before delivering the paper copy. Your request for a paper copy will not, by itself, withdraw your consent to receive Communications electronically.

You agree to keep your contact information current. To update your email address, mobile number, or mailing address, contact us at sales@tenff.com or update your information through the secure online portal.

6. Withdrawing Your Consent

You may withdraw your consent to receive Communications electronically at any time by emailing sales@tenff.com with the subject line “Withdraw E-SIGN Consent.” Withdrawal will be effective after we have had a reasonable opportunity to act on it. If you withdraw your consent before your application is funded, we may decline to proceed with the application. If you withdraw your consent after an account is opened, we may, at our option, terminate your account or change its terms, or continue to provide Communications in paper form and assess any applicable fee. Withdrawing your consent does not affect the validity or enforceability of any Communication provided before your withdrawal becomes effective.

7. Legal Effect

By consenting to this E-SIGN Consent, you agree that electronic Communications, electronic signatures, and electronic records will have the same legal effect as paper Communications signed and delivered in writing, and that they may be admitted as evidence in any proceeding to the same extent and under the same conditions as paper records.
